In the UAE, rent is usually paid with a set of post-dated cheques that the tenant gives the landlord when signing the lease. One, two, four, six or twelve cheques cover the year, and a separate cheque or payment covers the security deposit. The landlord deposits each cheque on its date. If one bounces, the landlord now takes a civil route: enforcing the cheque directly and, in Dubai, going to the Rental Disputes Centre. It is no longer a criminal complaint.

Here is how the arrangements work, what to watch for, and how both sides should track the cheques.

The number of cheques is agreed between you and the landlord and written into the tenancy contract. More cheques make each one smaller, but there are more dates to fund and more chances for one to land in a lean month. Monthly options and direct debit are growing, but post-dated cheques are still the norm.

Security deposit cheques

Dubai's tenancy law (Law No. 26 of 2007, Article 20) lets a landlord take a security deposit when the lease is signed, and requires them to refund it, or what remains of it, when the lease ends. The law does not set a percentage. In the market, deposits are commonly around 5% of annual rent for unfurnished homes and 10% for furnished ones, but this is negotiated, not fixed by law.

Some landlords take the deposit as a cheque they hold rather than cash. If you agree to that, write "security deposit" and the property reference in your own records against that cheque number, and get the landlord to confirm in the contract that it will not be deposited unless there is a valid claim. Ejari, Tawtheeq and what the landlord holds

In Dubai, every tenancy contract must be registered on Ejari, the RERA system run by the Dubai Land Department, under Law No. 26 of 2007 as amended by Law No. 33 of 2008. Abu Dhabi has its own system, Tawtheeq. A registered contract is needed for utilities, many government services and, importantly, any rent dispute.

By the time you move in, the landlord or property manager will usually hold:

  • the signed tenancy contract and Ejari or Tawtheeq certificate
  • your rent cheques, each dated for its instalment
  • a deposit (cash, transfer or cheque)
  • copies of your ID

Ask for a signed receipt listing every cheque number, amount and date. That list is your proof of what was handed over.

What happens if a rent cheque bounces

Since 2 January 2022 a cheque returned for insufficient funds is not a crime on its own. Under the Commercial Transactions Law, the landlord's bank must pay any available balance as a partial payment if the landlord accepts it. The returned cheque is an executory instrument, so the landlord can enforce the unpaid amount through the courts without first winning a lawsuit. Bad-faith acts, such as closing the account the cheques are drawn on, are still crimes. Details are in UAE cheque bounce law.

A bounced rent cheque is also a tenancy problem. Under Article 25 of Dubai's tenancy law, the landlord can seek eviction before the lease ends if the tenant fails to pay the rent, or any part of it, within 30 days of being served notice to pay. In Dubai, rent claims go to the Rental Disputes Centre, which needs the tenancy contract, the Ejari certificate and the bank's return memo. A bounce is also recorded against the tenant with the Al Etihad Credit Bureau. If you know a cheque will not clear, talk to the landlord before its date and replace it. Do not wait for it to bounce.

Replacing a cheque or paying early

A UAE bank cannot pay a cheque before the date written on it (Commercial Transactions Law, Article 648). A landlord cannot cash your June cheque in March, and you cannot "bring forward" a cheque without writing a new one. To pay early or change the bank account:

  1. Agree the change in writing with the landlord or agent.
  2. Hand over the replacement cheque or transfer.
  3. Get the original cheque back, or a signed note that it has been cancelled and will not be presented. A cancelled cheque you never recovered can still be deposited by mistake.
  4. Update your own record of both cheques.

Dubai has also offered direct debit for rent. In July 2022 the Dubai Land Department and Emirates NBD announced a system that debits rent from the tenant's account instead of collecting post-dated cheques. It is optional, so ask your landlord whether they accept it.

How tenants and landlords should track rent cheques

Tenants: Your risk is a cheque dated in a month when salary is late or other bills land at once. Keep a schedule of every rent cheque by date and check your balance the week before each one. The free PDC schedule generator builds the list of dates and amounts for a lease in a minute.

Landlords and property managers: You may hold hundreds of cheques across many units. Record each one against the unit, tenant, cheque number, bank and date. Deposit on the date (not earlier, because it will be returned). Mark each cheque cleared or returned straight away, so a bounce is followed up within days, not weeks.
